The correct answer is option 2, i.e. agree to pay $40 million as.

The error is in part B, where the word ‘agree’ must be corrected as ‘agreed’. ‘Agree’ is grammatically incorrect in the given sentence and must be corrected.

Hence, the statement can be correctly written as, ‘US carrier T-Mobile has agreed to pay $40 million as settlement for allegedly faking the ringtone on outgoing calls to rural areas with poor reception’.
